Fishing Charter Guest Acknowledgment and Release
Draft for legal reviewIn exchange for being allowed to participate in the fishing charter, boating excursion, transportation, dockside activities, and related activities (the "Trip"), I agree as follows.
1. Risks I accept
I understand that boating and fishing involve known and unknown risks, including changing weather and water conditions; waves, wakes, tides, currents, storms, heat, sun, and limited visibility; slips and falls; vessel movement, collision, grounding, capsizing, sinking, or equipment failure; drowning and delayed rescue; hooks, lines, knives, bait, fish, and wildlife; seasickness, dehydration, illness, or allergic reaction; and the acts of other participants or third parties. These risks may result in property loss, serious injury, disability, or death.
I knowingly and voluntarily accept the inherent risks of the Trip and all other risks to the maximum extent permitted by law.
2. Safety and health
I will follow the captain's lawful safety instructions, use required safety equipment, and not participate while impaired. I have disclosed any medical, mobility, allergy, swimming, or other condition that may affect my safety. The captain may refuse or end my participation when reasonably necessary for safety or legal compliance.
3. Release of claims
The "Released Parties" are the charter business, vessel, and their respective owners, operators, captains, masters, guides, crew, employees, contractors, agents, technology and service providers, insurers, affiliates, successors, and assigns.
To the maximum extent permitted by law, I release and agree not to sue the Released Parties for claims arising from or relating to the Trip, including claims involving inherent risks, ordinary negligence, property or equipment conditions, communication or scheduling errors, software or network failures, or the acts of participants or third parties.
This release does not apply to willful or intentional misconduct or any claim applicable law does not permit to be released or limited.
4. My conduct and property
To the maximum extent permitted by law, I will reimburse and hold the Released Parties harmless from third-party claims and reasonable costs caused by my unlawful, reckless, or intentional conduct or material breach of this agreement. I am responsible for my personal property.
5. Emergency care
If I cannot consent during an emergency, I authorize the captain, crew, or emergency personnel to arrange reasonable emergency care or transportation. I am responsible for resulting costs to the extent permitted by law.
6. Governing law and signature
Applicable federal maritime law governs where it applies. Otherwise, this agreement is governed by the laws of [STATE]. If any provision is unenforceable, the remainder will continue in effect. I have read and understand this agreement and sign knowingly and voluntarily. I intend an electronic signature to have the same effect as a handwritten signature, subject to applicable law.
Parent or legal guardian for a minor
I am the minor's parent or legal guardian and consent to the minor's participation. I agree to these terms on my own behalf and the minor's behalf to the maximum extent permitted by law.
